According to a lawsuit filed in the Southern District of Florida on May 13, Nunez suffered second-degree burns in late May 2025 after walking on the Lido Deck surface between the pool and deck chairs. The complaint describes a gap of roughly 20 steps.

The suit alleges the burn was not just unpleasant, but severe enough to cause lasting harm. Nunez is seeking more than $5 million in damages and a jury trial.

In the court filing. Nunez argues that he could not reasonably have expected the deck surface to reach temperatures capable of causing severe second-degree burns within seconds of ordinary contact. The complaint adds that there were no signs or other warnings about the risk of burns from the heat of the deck’s surface.

Nunez’s attorneys also claim Carnival should have known the danger long before his incident. The lawsuit says the manufacturer of the deck material allegedly told the company as early as 2014 that it could become dangerously hot.

The complaint further alleges a pattern of complaints across the cruise line. It says at least 25 Carnival guests had been similarly burned on Carnival’s ships in the six years before the incident, and that at least 42 passengers had complained about hot decks during the same period.

Nunez is asking for compensation for a range of impacts, including medical expenses, disfigurement, mental anguish, loss of earnings, and other repercussions. The suit also includes a punitive damages claim.

The complaint characterizes Carnival’s conduct in sharper terms than negligence alone. It alleges the company’s actions were “more than simply negligent,” describing them as willful, wanton, and showing a reckless disregard for the safety and rights of the plaintiff.

Carnival Corp., the cruise line’s parent company, told this outlet it does not comment on pending litigation. Attorneys listed for Nunez did not immediately respond to a separate request for comment.

Taken together, the lawsuit’s allegations place a central dispute in a simple question: when a deck is exposed to sunlight and becomes hot, what should passengers reasonably expect—and what warnings should they have been given before they stepped out barefoot?
