Shimmick moves to appeal Chickamauga Lock contract ending

Shimmick appeals – Shimmick Corporation says it has formally appealed the U.S. Army Corps of Engineers’ May 8 termination of its contract for the Chickamauga Lock replacement project, arguing it disputes the decision and will seek compensation tied to work costs.

CHATTANOOGA, Tenn. — Shimmick Corporation says it is not accepting the U.S. Army Corps of Engineers’ decision to end its role in the Chickamauga Lock replacement project.

In a statement posted on the company’s website. Shimmick says it is moving forward with a formal appeal of the contract termination. The company says the contract was signed with the USACE in 2017. with Shimmick agreeing to work with Chattanooga-based subcontractors on key replacement work on the Chickamauga Lock chamber.

USACE recently terminated the contract, telling the public that Shimmick was not meeting critical progress requirements on the project.

Shimmick says the contract termination took effect on May 8. The company says it will exercise its right to challenge the decision and seek compensation for work costs it says it is entitled to.

“While we dispute the termination. we respect and appreciate the USACE’s commitment to completing this project and believe it is critically important for there to be a true and accurate understanding of the challenges associated with this project to date. including the impact of certain change order requests on our work. We look forward to sharing this information through the appropriate channels, “ Shimmick CEO Ural Yal said.

The dispute now turns on two opposing portrayals of the same stretch of time: USACE’s assertion that critical progress wasn’t being met, and Shimmick’s position that the company should be judged in the context of challenges tied to change order requests.
