For Krispy Kreme customers who received a postcard notice tied to the chain’s November 2024 data breach, the clock is already running out.
Monday, June 22 is the deadline to be eligible for a payout in the company’s $1.6 million settlement stemming from a class-action lawsuit. Claims must be submitted or postmarked by then.
The lawsuit alleges Krispy Kreme failed to prevent a breach, saying private information—including names, dates of birth, Social Security numbers, and financial account access information—was leaked. Krispy Kreme denies any wrongdoing or liability.
Krispy Kreme says that on Nov. 29, 2024, it detected suspicious activity on its computer systems. The company confirmed that cybercriminals accessed and stole personal information from 161,676 former and current employees, according to the settlement agreement.
Who is included in the class
Class membership applies to individuals residing in the United States who were sent a notice stating their private information may have been impacted, as described on the Krispy Kreme settlement website.
What class members can receive
Class members who file a claim are eligible for a $75 cash payment, according to the settlement website. The total payout could change depending on how many claims are filed.
For those with documented losses, the settlement provides for reimbursement for fraud, identity theft and other losses—up to $3,500. Proof must be included in the claim form, including receipts, emails, or phone records.
Even if a class member does not submit a claim, the settlement website states they will still receive access to one year of credit monitoring. The site also says class members should have received an activation code on their postcard notice.
How to file a claim
Krispy Kreme class members can submit claim forms either on the settlement website or by mailing them to the settlement administrator at the address listed on the claim form.

The company’s reported costs
Krispy Kreme recorded an estimated $5.0 million in operational inefficiencies related to “the 2024 Cybersecurity Incident. ” according to its first quarter 2025 earnings report. The earnings report also describes $4.4 million in costs spent on remediation efforts, including “fees for cybersecurity experts and other advisors.”.
The settlement, in other words, is playing out on two timelines at once: one for potential compensation tied to the breach notice and claim process, and another reflecting the company’s internal tally of remediation work following the incident.
By Monday, June 22, class members who want to pursue the $75 payment—and any additional reimbursements where losses are documented—need to ensure their claim is submitted or postmarked in time.
