“So first of all, this is such an insult, the idea that you can have a private citizen and a fake group who said that they walk their dog near the White House, so they get standing to sue the president of the United States, over a national security facility in the White House complex, is such an insult to the legal profession, to our judicial system and for the judiciary to go along with this is a blight, it is a blight on Article 3,” Miller said to Fox News host Laura Ingraham.
He added that he believes there is a “crisis in the courts” and called on the Supreme Court to step in and rein in “rogue” federal judges. He also continued the much-repeated line of calling the ballroom a national security issue.
“We just had the attack at the White House Correspondents’ Dinner, and we’re actually having this conversation?” Miller asked. “Shame on these judges; let’s get real in this country, let’s have a court system that actually upholds the law instead of making it, Laura.”
The U.S. Court of Appeals for the D.C. Circuit, in a 2-1 decision, affirmed a preliminary injunction granted earlier this year to the National Trust for Historic Preservation, the “fake group” Miller was referring to.
The appeals, however, stayed its own ruling to give the Trump administration time to appeal to the Supreme Court.
