Mark Sanchez, the former NFL quarterback and Fox Sports analyst, filed a motion on Thursday, Sept. 3, to plead guilty in the criminal case centered on a violent altercation with a truck driver last year in Indianapolis, according to Marion County (Ind.) court records.
A jury trial had been scheduled to begin on Tuesday, Sept. 8, after five postponements. Sanchez had faced several charges, including felony battery resulting in serious bodily injury.
It was not immediately clear to which charges Sanchez planned to plead guilty. He also requested a sentencing hearing. A judge will have to accept Sanchez’s guilty plea.
“This is a positive development,” Sanchez’s legal advisor, Nick Sanchez Jr., said Sept. 3 in a statement to USA TODAY Sports. “We are finalizing an agreement with the prosecutor’s office that provides a path toward resolving the state’s case. We’re also encouraged by the constructive conversations taking place regarding the related civil matter. There is real momentum toward bringing this entire chapter to a close.”
In October 2025, Sanchez was arrested after allegedly assaulting a truck driver named Perry Tole, who said he stabbed Sanchez in self-defense. Sanchez was in Indianapolis to broadcast a Las Vegas Raiders at Indianapolis Colts game for Fox Sports, which parted ways with him in November 2025.
Tole filed a civil suit in Marion Superior Court against Sanchez and FOX Corporation, in which he said he “suffered severe permanent disfigurement” as a result of the attack. In December 2025, FOX Corporation filed a motion to remove the case to federal court. On Sept. 3, attorneys for both sides said they were nearing a resolution in the civil case.
“We are pleased with the constructive and professional conversations we’ve had with Mr. Sanchez’s team,” Matt Golitko, Tole’s attorney, said in a statement to USA TODAY Sports. “Our discussions have been productive and we’re on a positive path toward an agreement that will allow the parties to move forward. Mr. Tole appreciates the progress we have achieved and looks forward to an amicable resolution.”
The fight between Sanchez and Tole happened on Oct. 4, 2025, in an alley behind the Westin Hotel in downtown Indianapolis. According to a probable cause affidavit obtained by USA TODAY Sports, Tole had his truck parked in the hotel’s loading dock area and was preparing to replace the hotel’s frying oil when Sanchez approached. Tole told police that Sanchez said the hotel manager did not want him to replace the oil and repeatedly tried to climb into Tole’s truck.
After Sanchez shoved Tole, according to the affidavit, the truck driver pepper sprayed Sanchez in the face. When Sanchez continued coming toward him, Tole stabbed Sanchez with a knife. Tole also told police that he smelled alcohol on Sanchez’s breath and that the former quarterback’s speech was slurred.
Police also reviewed surveillance footage that showed Sanchez grabbing and throwing Tole towards the wall of theWestin and showed the two men fighting in the alley, the affidavit said.
As part of his civil lawsuit, Tole submitted photos of his injuries from the attack. The photos, reviewed by USA TODAY, show Tole laying shirtless in a hospital bed with a deep cut on his left cheek and blood on his face, chest and shoulders.
Sanchez was initially charged with misdemeanor battery resulting in injury, public intoxication and unlawful entry of a motor vehicle. Marion County Prosecutor Ryan Mears later announced an added felony charge of battery resulting in serious bodily injury. If convicted on the felony charge, Sanchez could have been sentenced to between one and six years in prison.
After starring at the University of Southern California and becoming the No. 5 overall pick of the New York Jets in 2009, Sanchez, 38, played for nearly a decade in the NFL. He then began his broadcasting career with ESPN before moving to Fox Sports in 2021.
