After criticism of the sudden decision to reinstate the U.S. striker for the game. FIFA president Gianni Infantino stepped in with a direct message meant to steady the tournament’s legal framework. In a statement. Infantino said he had seen public comments about the decision made by the independent FIFA Disciplinary Committee connected to Balogun’s suspension.
“FIFA’s judicial bodies are independent,” Infantino said. “They operate autonomously. apply the FIFA Disciplinary Code. and decide cases based on the applicable regulations and the specific facts before them. Their independence is essential to the credibility and integrity of football, and this must always be respected.”.
He also addressed the reality that politics and power often orbit major tournaments. Infantino said he regularly discusses World Cup matters with the President of the United States. adding that he received a call from President Donald Trump on this specific issue. The FIFA president said that during their conversation he explained there was an ongoing legal process involving FIFA’s independent judicial bodies and that the case would be decided in due course by the competent bodies.
Infantino continued: “I read the decisions of the FIFA Disciplinary Committee when they are issued. Sometimes I am surprised by them. Sometimes I agree with them, and sometimes I disagree.”
Then came the line FIFA clearly wanted to end on: “What I always do. however. is respect those decisions and the autonomy of the bodies that make them. Whether we personally like a decision or not is irrelevant. Respect for independent institutions and the rule of law is what protects the integrity of our competitions and the credibility of FIFA at all times.”.
But the case has left room for doubt — because the governing rule described in the criticism points to wide room for discretion. In this specific situation. the issue is tied to Article 27 of the FIFA Disciplinary Code. which provides the independent committee broad discretion to decide whether an otherwise automatic suspension from a red card will. or will not. be served.
The criticism also goes further, questioning whether Infantino could have direct or indirect influence over the appointment or retention of members of FIFA’s Disciplinary Committee — a point that challenges the independence FIFA insists is absolute.
