For former CIA Director John Brennan, the fight is starting before the next court fight has even arrived.

On Wednesday. Brennan filed a lawsuit against the Trump administration in federal court in Washington. demanding a court order that would require officials to preserve records from investigations he says are targeting him. His central demand is straightforward but consequential: he wants the paperwork kept intact because. in his view. it may be necessary to defend himself if he is later indicted.

Brennan’s lawyers argue that the documents would be essential if any future indictment is brought by the Republican administration. They describe the purpose of the records in stark terms—so that Brennan can prepare motions on “vindictive prosecution grounds” if charges follow.

The lawsuit names President Donald Trump and other senior law enforcement officials from his administration. Among the defendants are acting Attorney General Todd Blanche and FBI Director Kash Patel. Brennan’s case also targets the prosecutors in Florida who have been overseeing investigations related to Brennan and other former government officials.

The request for preservation places the dispute at a particular, high-pressure point in the legal process. It is not just about whether investigations exist or what they may lead to—it is about whether the evidence that could later matter to Brennan’s defense will survive long enough for a court to review it.

With Brennan asking for a judge’s order to preserve the records now, the immediate stakes are practical.
