When the Supreme Court upheld a ban on transgender athletes playing on female school sports teams on Tuesday, the split wasn’t just ideological—it was about whether facts are supposed to matter at all.
Justice Sonia Sotomayor, speaking from the bench, called the majority’s approach cold and sweeping. “The majority’s opinion ends by reciting the many wonderful ways in which playing sports can be valuable to young people. ” she said. “It can help build resilience, tenacity, leadership, and discipline. It can lead to life-long friendships, community, and a sense of belonging. It can bring joy and the thrill of victory, along with all the lessons one learns from experiencing defeat. The benefits are immense.”.
But Sotomayor said that while the opinion praised the benefits of sport, it ignored what those benefits would mean for a particular student—B. P. J.—after the court’s ruling.
The case turned on how the Constitution and federal law should be read. Justice Brett Kavanaugh wrote the majority’s ruling that upheld the ban. The decision held that Title IX and the Equal Protection Clause allow bans on transgender girls’ and women’s participation in female school sports to stand.
All three liberal justices—Sotomayor, Elana Kagan and Ketanji Brown Jackson—dissented in part. They agreed with the conservatives on Title IX, but they dissented from the majority’s finding involving the Equal Protection Clause.
In her dissent. Sotomayor said the ruling will exclude transgender student athletes even in situations where they do not have an “inherent athletic advantage.” She argued that after Tuesday’s decision. West Virginia—and any other state actor—will be able to deny students like B. P. J. the chance to play based on how the Court believes the “inherent athletic advantage” question should be handled. not on what the facts show.
“Because of the Court’s decision today, West Virginia, and any other state actor, can deny B. P. J. and others like her these experiences simply because it thinks they have an inherent athletic advantage, even if the facts show that they do not,” Sotomayor argued.
She said the ruling turns a factual inquiry into an automatic outcome. “In the end, to the Court, the facts do not matter, even though the consequences are serious.”
Sotomayor emphasized that the ban is absolute under the ruling. “The ban is absolute, so B. P. J. cannot practice on girls’ teams. even if she would not take anyone’s spot in an eventual competition. even if everyone who tries out for the team makes it. and even if having the chance to participate could aid immensely in treating B. P. J.’s gender dysphoria.” She added that while sports can become zero-sum. she said the law “need not and should not be.”.
She also said the Court reduced the burden the Constitution places on state actors when they classify based on sex. “Because the Court today errs by reducing the burden. at least in the sports context. that the Constitution places on state actors when classifying based on sex. So basically they’re saying facts don’t matter? cool cool.
I read the headline and was like here we go again. They keep talking about Title IX but it feels like they just wanna ban people and call it “safety.”
Not to be dramatic but if a trans kid isn’t “inherently” advantaged then why are they still getting barred? Sounds like the court is just making a rule for everyone, then pretending it’s nuanced.
This is why I hate Supreme Court decisions. They always act like they read the “facts” but then it’s just politics. Also West Virginia is mentioned but I bet they’ll change the whole thing right after, watch.
