Neil Brooks’ $2m fraud case ends after decade

A Brisbane District Court has formally abandoned the fraud prosecution against former Olympic swimmer Neil Brooks and his wife Linda, ending charges tied to a $1.95 million investment made in 2008 after a long legal battle that stretched almost a decade.

Neil Brooks and his wife Linda learned in the middle of a long. hard wait that the court case they had been living with for years was finally about to be dropped. In Brisbane. prosecutors told Judge Anthony Rafter they would not proceed—bringing to an effective end a fraud prosecution that began with their arrests in late 2017 and followed them for almost 10 years.

The charges alleged dishonest representations made to induce investor Glenn Melcheck and his wife to pay $1.95 million for a 50 per cent stake in the Brooks’ sports merchandise company in 2008. The couple had been introduced in late 2007 by a third party, met repeatedly, and then signed an agreement in January 2008.

Days later, the Melchecks paid a $50,000 deposit. The company—since described as now-defunct—collapsed within months.

In court on Wednesday, the prosecution’s decision meant the case was formally abandoned in Brisbane District Court, with the judge effectively hearing that the prosecution would not continue. Brooks’ lawyer, Daniel Hannay, said the couple were “finally vindicated after almost a decade.”

Hannay’s statement came with a personal note from Brooks after a FaceTime call the night before. “We had a FaceTime discussion last night where I gave them the good news,” he said in a statement. “There were lots of tears – but not many words. They are both ecstatic that the matter is finally over, and they can move on with their lives.”.

The legal fight had also dragged Brooks and Linda into a wider set of allegations raised during proceedings. The court heard about alleged relationships with major European football clubs, including Chelsea, Arsenal and Manchester United.

The arrests that kicked off the case were abrupt. Neil Brooks was arrested when he flew into Brisbane International Airport and surrendered to detectives from the Financial and Cyber Crime Group in November 2017. Linda Brooks was arrested and charged with fraud after flying into Perth International Airport on October 13, 2017. Prosecutors alleged the couple. as directors of the company. made misleading claims about the business’s success and prospects to induce the investment.

For Brooks. the legal battle ran alongside a public sporting history that remains central to how many Australians still remember him. He won gold in the 4x100m medley relay at the 1980 Moscow Olympics and was part of Australia’s famed “Mean Machine” relay team. After his swimming career, he went on to work as a television presenter.

The moment prosecutors chose not to proceed closed the door on a prosecution that had outlasted the original investment agreement by years and left the couple, in Brooks’ words, able at last to move forward.
