Weinstein Retrial Ends in Mistrial as Jury Deadlocks

Weinstein retrial – Harvey Weinstein’s New York rape retrial was declared a mistrial after the jury deadlocked following three days of deliberations, setting up prosecutors’ decision on whether to seek a fourth trial.

Harvey Weinstein once again sat through a courtroom standoff that ended without a verdict. After three days of deliberations, the jury remained deadlocked, and the judge declared the rape retrial a mistrial in New York.

The disgraced movie mogul faced one count of third-degree rape involving former aspiring actress Jessica Mann. That charge previously collapsed in a June 2025 mistrial, meaning Weinstein has now reached the same procedural dead end for the third time.

Judge Curtis Farber ruled that prosecutors have 30 more days to decide whether to try the case for a fourth time. Weinstein remains in jail because of his prior related conviction.

District Attorney Alvin L.. Bragg Jr.. said his office respects the process even as it expressed disappointment.. “While we are disappointed that the proceedings ended with a mistrial. we deeply respect the jury system and sincerely thank all of the jurors for their time and dedication. ” Bragg said in a Friday statement.. He added that Mann “has fought for justice” for nearly a decade. and that her perseverance and bravery have been felt by people in the case and “more importantly” by survivors everywhere.

Bragg’s statement also pointed to what happens next. tying the decision to both the victim and the sentencing already in motion.. “We will consider our next steps in consultation with Ms.. Mann. and in consideration of Harvey Weinstein’s pending sentencing following last year’s trial conviction for forcibly sexually assaulting Miriam Haley. ” the statement continued.

Last year, Weinstein was found guilty of first-degree sexual assault for forcibly subjecting former “Project Runway” production assistant Miriam Haley to a sex act in 2006. In the same case, he was acquitted on a second charge tied to sexually assaulting former model Kaja Sokola, also in 2006.

“We will continue to prosecute crimes of sexual violence – no matter who the defendant is – in a survivor-centered manner that uplifts their voices in the pursuit of justice,” Bragg said.

Weinstein’s public reaction has stayed defiant. During the time a partial verdict was announced in an earlier stage, he told the court: “My life is on the line, and you know what? It’s not fair. It’s time, it’s time, it’s time, it’s time to say this trial is over.”

This New York case is unfolding alongside other punishment already imposed. Weinstein is serving a 16-year sentence in California following his December 2022 conviction, though that California verdict is under appeal, after his initial 2022 New York conviction was thrown out.

  1. How is it a mistrial if they deadlocked? That’s not justice, that’s just dragging it out. I feel bad for that Jessica Mann lady.

  2. I don’t get it, didn’t he already get convicted? Like he’s in jail in California for 16 years so why keep doing this New York stuff over and over? Sounds like the DA wants headlines more than answers.

  3. Judge says 30 days to decide a fourth trial like it’s some kind of schedule change. Meanwhile survivors are waiting years. Also I swear every Weinstein story ends in another delay, deadlock, or appeal, and that’s exhausting.
