Attorney Challenges Megyn Kelly Over Rape Case Commentary

Thomas P. Giuffra, attorney for a Cornell University sexual assault survivor, is pushing back after Megyn Kelly criticized his client’s delay in reporting the incident.
The silence of a decade is a heavy weight. yet it is one that now defines the public clash between a prominent media voice and an attorney fighting for his client’s reputation. Thomas P. Giuffra. representing a woman known as Jane Doe. publicly challenged Megyn Kelly this week following the commentator’s remarks regarding a gang rape lawsuit involving Cornell University’s Chi Pi fraternity.
During her podcast on Monday, Kelly questioned why Doe waited two weeks to report the assault. In the same broadcast, she characterized the accuser as “not the most attractive gal,” and suggested the woman likely enjoyed the sensation of being “desired and wanted” by her assailants.
Giuffra responded to these comments on Wednesday with a sharp, pointed inquiry: “Ms. Kelly has publicly condemned Ms. Doe for taking two weeks to go to the police. I would ask Ms. Kelly why it took her over a decade to report unwanted sexual advances from her boss?”
That question hits on a contradiction that has fueled the latest cycle of the dispute. In her 2016 memoir. Kelly recounted that former Fox News chairman Roger Ailes began sexually harassing her shortly after she joined the network in the early 2000s. While she consulted with a lawyer at the time, she ultimately chose silence. As she wrote in her book, she understood that if she “caused a stink, my career would likely be over.”.
The underlying case involves a harrowing account from Doe. who alleged she was plied with alcohol and drugs at the Chi Pi fraternity house before being assaulted by multiple men. The aftermath led Doe to drop out of school entirely. Institutional consequences for the seven men named in the lawsuit were varied: two were expelled. two were suspended. and three received lighter punishments. On October 5. 2026. thousands of Cornell students and community members gathered at Ho Plaza for a protest organized by twenty student organizations to demand justice for survivors.
Giuffra argued that Kelly is using her platform to foster an abusive environment for victims. “Perhaps she should reflect why it is difficult for women to come forward under these circumstances and honor the courage that it takes. ” he said. “It gives others permission to attack. It goes without saying that Jane Doe has been through enough.”.
Documents from the university’s own investigation. including transcripts obtained by the press. indicate that Doe’s perspective on the incident evolved significantly over time. As the legal battle continues. the dialogue between the attorney and the commentator serves as a reminder of the complex. often fraught expectations placed upon those who choose to speak out.
